Provisions on the On-line Verification of Citizens' Identity Information by Banking Financial Institutions (for Trial Implementation)

  Article 1 For the purposes of regulating the on-line verification of citizens' identity information by banking financial institutions (hereinafter referred to as banking institutions), carrying into further effect the rules on real-name bank accounts, promoting the construction of the social credit system, carrying into effect the anti-money laundering work, and maintaining the normal economic and financial order, these Provisions are formulated in accordance with the Anti-money Laundering Law of the People's Republic of China, the Provisions Concerning the Real-Name Personal Savings Account System, Measures for the Administration of RMB Bank Settlement Accounts and other laws, regulations and ministerial rules.

  Article 2 The term "on-line verification of citizens' identity information" (hereinafter referred to as on-line verification) means the check or consultation of the citizens' identity information through the system of on-line verification of citizens' identity information so as to verify the genuineness of the name, identity card number, photograph, issuing organ and other information as indicated in the relevant individuals' resident identity cards.

  Article 3 A banking financial institution may access to the on-line verification system through its comprehensive business system and conduct an on-line verification by logging onto the on-line verification system through the RMB bank settlement account management system or through the basic database of personal credit information, or may conduct an on-line verification by directly logging onto the on-line verification system.

  Article 4 When a banking institution handles the following RMB bank businesses, for example, under any law, regulation or ministerial rule, it is required to verify the resident identity cards presented by the relevant individuals, it shall conduct an on-line verification:

  1. The bank account business, including the opening of and modifications to individuals' savings accounts, individuals' bank settlement accounts and entities' bank settlement accounts.

  2. The payment and settlement business, including the settlement of instruments, bank card settlement services, acceptance of instruments, etc.

  In these Provisions, the bank businesses subject to on-line verification are generally referred to as the prescribed businesses.

  Apart from the prescribed businesses, a banking institution may conduct an on-line verification when it handles other bank businesses for the purpose of intensifying the internal management.

  Article 5 When a banking institution handles a prescribed business, if it is required to finish the business for a client on the spot, it shall conduct an on-line verification of the individual's citizen identity information on the spot. If it is not required to finish the business on the spot, it shall conduct such an on-line verification before it finishes the relevant business.

  Article 6 When a banking institution conducts an on-line verification for handling a prescribed business, if the relevant individual's name, citizen identity number, photograph and issuing organ completely conform to the information as indicated in the resident identity card, the banking institution may continue to handle the business under the pertinent provisions.

  Article 7 When a banking institution conducts an on-line verification for a prescribed business, if there is any discrepancy in one or more of the items such as the individual's name, citizen identity number, photograph and issuing organ and if it is able to exactly discern whether the resident identity card presented by the client is a fake one, the banking institution shall refuse to handle the relevant businesses for this client.

  Article 8 When a banking institution conducts an on-line verification for a prescribed business, if there is any discrepancy in one or more of the items such as the individual's name, citizen identity number, photograph and issuing organ and if it is unable to exactly discern whether or not the resident identity card presented by the client is a fake one, it shall do as follows:

  1. If the client applies for handling the bank settlement account business for an entity, the banking institution shall suspend handling the business. At same time, it shall definitely inform the client of the verification result and further verify the genuineness of the resident identity certificate of the relevant individual in a timely manner. If his resident identity certificate is found to be a fake one upon verification, the banking institution shall refuse to handle the business for the client, otherwise, it shall continue to handle the business under the relevant provisions.

  2. If the client applies for handling the bank account business for an individual, the banking institution may continue to handle the business for the client. Whether or not the banking institution continues to handle the business, it shall expressly inform the client of the verification result. If the banking institution continues to handle the business, it shall register the client's contact information in detail (such as the address, telephone number, etc., the same hereafter) and shall, after handling the business, further verify the genuineness of individual's resident identity card in a timely manner. If the resident identity card is found to be a fake one upon verification, the banking institution shall immediately stop handling the payment and settlement business through the relevant account. For the business of opening an account, the banking institution shall timely inform the client to cancel the account and report the relevant information to the local branch institution of the People's Bank of China. For the business to modify the account, the banking institution shall take timely remedies to resume the original status and notify the real depositor and report the relevant information to the local branch institution of the People's Bank of China.

  3. If the client applies for handling the payment and settlement business, the business institution may, according to the pertinent regulations and the internal management requirements, decide whether or not to handle the relevant business for the client. If the banking institution refuses to handle the business for the client, it shall expressly inform the client of the verification result. If the banking institution suspends handling the business for the client, it shall timely verify the genuineness of the pertinent individual and decide whether or not to continue to handle the business according to the verification information. It shall register the client's contact information in detail and shall, after handling the business, further verify the genuineness of individual's resident identity card in a timely manner. If the resident identity card is found to be a fake one upon verification, the banking institution shall immediately stop handling the payment and settlement business through the relevant account. For the business of opening an account, the banking institution shall timely inform the client to cancel the account and report the relevant information to the local branch institution of the People's Bank of China.

  Article 9 When a banking institution conducts an on-line verification for any business other than the prescribed businesses, it shall work out concrete methods for the on-line verification on the basis of the nature of the business, type of the client, amount, risk degree and other factors and report them to the local branch institution of the People's Bank of China for archival purposes.

  Article 10 When the outlet of a same banking institution handles a prescribed business, if it has already conducted an on-line verification when it handled the bank business for the relevant individual before and his citizen identity information has not changed yet, it is not required to conduct an on-line verification. If it doubts the genuineness of the genuineness of the relevant individual citizen's identity information that it obtained previously, it shall conduct a new on-line verification.

  Article 11 When a banking institution conducts an on-line verification, if it doubts the verification result, it may apply to the public security organ for a further verification.

  Where a client questions the on-line verification result, the banking institution shall, after the on-line verification, issue to him a certificate for the discrepancies of the information indicated in the relevant individual's resident identity certificate (see the format attached) and inform him that he may verify the information in the public security organ of the place where the permanent residence of the person verified is located.

  Article 12 When a banking institution conducts an on-line verification or further verifies the information indicated in the relevant individual's resident identity certificate, if it finds that the client opens a bank account or handles any other bank business with a fake resident identity card, he shall timely report to the public security organ.

  Article 13 When a banking institution handles a prescribed business, if it can not conduct a normal on-line verification for network failure or for any other reason, it may verify by other means the individual's resident identity information and handle the relevant business, but it shall register the prescribed businesses handled during the period of network failure and shall, after the problem is solved, conduct an on-line verification of the information indicated in the resident identity certificate of the relevant individual. If there is any discrepancy in one or more of the items such as the individual's name, citizen identity number, photograph and issuing organ and if it is able to exactly discern whether the resident identity card presented by the client is a fake one or if it is found to be a fake one upon further verification, the banking institution shall immediately suspend handing the relevant business and shall, under the relevant provisions, terminate the business relationship with the client or take corresponding remedies.

  Article 14 The banking institution shall establish a sound on-line verification emergency mechanism so as to ensure the on-line verification and the prescribed businesses can be carried out normally and lawfully.

  Article 15 A banking institution shall keep confidential the citizen identity information that it obtains during the on-line verification. It shall not provide such information to any entity or individual unless it does so in pursuance of the law. No banking institution may use the citizen identity information which it obtains during the on-line verification for any purpose other than handling bank businesses.

  Article 16 The power to interpret and amend these Provisions shall remain with the People's Bank of China.

  Article 17 These Provisions shall be implemented as of the date of running of the on-line verification system.
